Článek vychází z diskuse vedené na mezinárodní konferenci Rethinking Sentencing: Are We Getting Justice Right?, pořádané Univerzitou Karlovou v Praze a zasazuje ji do širšího kontextu české sankční politiky. Zaměřuje se na vývoj a současnou podobu alternativního trestání ve vztahu k původní koncepci trestního zákoníku i následným legislativním změnám. Poukazuje na deficity v koncepci trestání a systému alternativních trestů a dospívá k závěru, že v blízké budoucnosti bude nezbytné ještě více rozšířit jejich aplikační prostor i do sféry zločinů.

This article draws on a discussion held at the international conference “Rethinking Sentencing: Are We Getting Justice Right?”, organized by Charles University in Prague, and places it within the broader context of Czech sentencing policy. It focuses on the development and current state of alternative sentencing in relation to the original concept of the Criminal Code and subsequent legislative changes. It highlights shortcomings in the concept of punishment and the system of alternative sanctions and concludes that in the near future it will be necessary to further expand their scope of application to include the sphere of crimes.
