Příspěvek se zabývá aktuálně diskutovaným tématem, jímž je tvorba deepfakes ve spojení s vyvozením trestněprávní či správněprávní odpovědnosti. První část příspěvku představuje obecná východiska v oblasti deepfakes, způsoby jejich tvorby a jejich rizikovost pro společnost. V následujících částech se již autoři podrobněji zaměřují na deepfakes se se - xuálním kontextem, kdy přibližují právní kvalifikaci materiálů zobrazující děti, dospělé osoby a známé osobnosti. Závěrečná část příspěvku pojednává o spe - cifických otázkách spojených s odhalováním, prověřováním a dokazováním těch - to deepfakes. Jednotlivé části reflektují a zprostředkovávají poznatky a zku - šenosti z aplikační praxe.

The article deals with the currently discussed topic of deepfakes creation in connection with the imposition of criminal or administrative liability. The first part of the article presents general principles in the field of deepfakes, methods of their creation and their risk to society. In the following parts, the authors focus in more detail on deepfakes with a sexual context, where they explain the legal qualification of materials depicting children, adults and celebrities. The final part of the article discusses specific issues related to the detection, verification and proof of these deepfakes. The individual parts reflect and convey knowledge and experience from application practice. The article deals with the currently discussed topic of deepfakes creation in connection with the imposition of criminal or administrative liability.
