Článek pojednává o novém smluvním právu v České republic. Text pojednává nejprve o uzavírání smluv podle obchodního zákoníku.Dále pojednává o uzavírání smluv podle občanského zákoníku a podle nového občanského zákoníku.Podle obchodního zákoníku bylo třeba zásadně dohodnout celý obsah smlouvy a pojmenované smlouvy musely obsahovat podstatné části smluvního typu.Podle nového občanského zákoníku vznikne smlouva dohodou o podstatných nálezitostech smlouvy. |

The article discusses new contract law in the Czech Republic.The text deals with contracts under the Commercial Code, the Civil Code and the new Civil Code.In Commercial Code was necessary to fundamentally agree entire contents of the contract and the contract had named contain a substantial part .In new Civil Code a contract agreement has the essential aspects of the contract. |
