Öffentliche Aufträge generieren relativ stabile Geschäftsbeziehungen mit gesicherten Finanzierungen. Für den Unternehmer, der die Bestellung erhält, wird das Risiko minimiert, die vereinbarte Zahlung nicht zu erhalten. Um diese Verträge auf transparente und nicht diskriminierende Weise zu erhalten, versuchen auch die neuen EU-Richtlinien und die damit verbundene innerstaatliche Regulierung einen Beitrag zu leisten. Der Artikel diskutiert eine neue Anpassung. Insbesondere ist es eine Frage, ob Verträge auf weniger formelle Art und Weise eingereicht werden können und ob elektronische Einreichungen erweitert werden.

Anotace Na základě veřejných zakázek vznikají relativně stabilní obchodní vztahy se zajištěným financováním. Pro podnikatele, který zakázku získá, je minimalizováno riziko, že za jím poskytnuté plnění neobdrží dohodnutou úplatu. K tomu, aby při získávání těchto zakázek bylo postupováno transparentně a nediskriminačně, se snaží přispět i nové směrnice EU a na ně navazující tuzemská úprava. V příspěvku jde o pojednání o nové úpravě. Jde zejména o zjištění skutečnosti, zda lze zakázky zadávat méně formálním způsobem a zda se zde rozšiřuje elektronizace zadávání.

Under public contracts, suppliers are able to make large-scale deliveries. There is a large part of socially available resources. Under public contracts, there is a relatively stable business relationship with scured financing, and the risk of not getting the agreed payoff is minimized for the contractor who gets the contract. In order to be transparent and non-discriminatory in the procurement proces, the new EU directives and the related domestic regulation are also intended to contribute. The contribution is a comparison of the previous and the adjustments.It is mainly about finding out whether the contrats can be entered in less formal way and whether the electronization of the assignment is begin extented here.
