Immunities and privileges have grown from their ancient historical roots. In the form in which they exist today, their importance has shifted significantly. It can be expressed briefly as the fact, that while they were originally, according to their content, the personal advantages for certain individuals or groups, today they are granted to the persons and bodies exercising public power as a guarantee of the possibility of their free, dignified and undisturbed performance. In this context, the question is asked to what extent immunities are in accordance with the principle of equality, and the answer to this is positive if the other rules of the democratic society are respected. Although the functioning of parliamentary democracies are based on the cooperation between the government and the parliamentary majority, the importance of immunities is not lost, because the mission is to protect the parliament as a whole, including the minorities. In the concrete form, immunities of the deputies usually include freedom from arrest and freedom of speech and are modified differently in various constitutions. It applies, with few exceptions, to voting and, to a large extent, to speeches made in the Parliament. It also applies to actions that are connected with exercising their mandate. The concrete form of immunities and privileges, which are granted primarily to the heads of state, is demonstrated in examples of selected constitutions of the European countries.

Imunity a výsady vyrostly ze svých dávných historických kořenů, nicméně v podobě, v jaké existují dnes, se jejich význam výrazně posunul: ve stručnosti to lze vyjádřit tak, že zatímco původně byly svým obsahem osobními výhodami pro určité jednotlivce nebo skupiny, v současnosti jsou přiznávány osobám a orgánům, vykonávajícím veřejnou moc jako garance možnosti jejich svobodného důstojného a nerušeného výkonu. V souvislosti s tím je kladena otázka, nakolik jsou imunity v souladu s principem rovnosti, a odpověď na to je kladná, jsou-li dodržena ostatní pravidla demokratické společnosti. Třebaže fungování parlamentních demokracií je založeno na spolupráci mezi vládou a parlamentní většinou, význam imunit se nevytrácí, protože jejich posláním je chránit parlament jako celek, tedy i menšiny. V konkrétní podobě mají imunity poslanců podobu je freedom from arrest a freedom of speech v jednotlivých ústavách různě modifikovanou. Až na výjimky se plně vztahujíe na hlasování a v široké míře i na projevy učiněné na půdě parlamentu nebo v souvislosti s výkonem mandátu. Konkrétní podoba imunit a výsad, které jsou přiznávány především hlavám státu, je demonstrována na příkladech vybraných ústav evropských zemí.
