Course objectives
The course focuses on explaining the importance of consumer protection in the financial markets in all its contexts. The main objective of the course is to teach students how to protect consumers in the financial markets against unfair practices by financial institutions, and to be able to detect such behavior. Another aim of the course is to acquaint students with consumer protection legislation, not only in the Czech legal order, but also in the European context, focusing on the possibility of consulting services, including end consumers. the amicable settlement of disputes.
Learning outcomes
The student will be able to orientate himself / herself in the problem of legal regulation of consumer protection and in practice apply these principles, thus protecting him / her as a future professional working at the financial market.
Syllabus
  • 1. Characteristics of consumer protection legislation, sources of law in the Czech Republic and the EU definition of basic concepts consumer protection, regulation and supervision of consumer protection in general and focusing on the financial markets. 2. Characteristics of the Consumer Protection Act and the detailed interpretation of certain provisions. 3. Protection of consumers in respect of contracts negotiated away from the usual place of business. 4. Protection of consumers in distance contracts. 5. Protection of consumers in selected areas of the financial market - payment services, collective investments, consumer loans. 6th Alternative dispute resolution - general approaches, characteristics. 7th Alternative dispute resolution - the proceedings before the Financial Arbiter (competence, initiating proceedings, decisions, appeals) 8th Alternative dispute resolution - arbitration (arbitration clause, the arbitrator and his position, competence, initiating proceedings, the arbitral award) 9th Judicial dispute resolution - meaning the courts and their role in resolving disputes in the area of ​​financial-legal relations. 10th Role MoF, CNB, and CTI in regulation, oversight and supervision of consumer disputes. 11. Control codes of conduct on consumer protection in financial services. 12. Summary and appreciation, emphasizing the fundamental principles of consumer protection, case study.

Teaching methods
Lectures in full-time study, tutorials in part-time study. Compulsory lectures participation is 75% in full-time study, compulsory tutorial participation is 60% in part-time study.
