Course objectives
Explain the principles of EU law, its institutional backgrounds and in connection with it the issue of creation and implementation of the EU Common Security Policy, policy of judicial and police cooperation – EUROPOL, EUROJUST. Areas to be covered include further on the instruments for police and judicial cooperation like request for cooperation in criminal proceedings, cross-border provision of evidence and European arrest warrant. Last but not least, the lectures will deal with issues of police and judicial cooperation between Czech Republic and other EU member states as well as with the UK after its withdrawal of EU membership.
Learning outcomes
- After participating in the course the student will have good knowledge about the the fundaments of institutional background of the EU and its instruments in police and judicial cooperation between EU member states. With this knowledge the student will be able to - · identify legal problems in the European security area: - · analyse the applicable legal solutions; - · identify and analyse effective EU law and relevant EU case law - · present and discuss different aspects of European criminal and security policy oriented to strengthen the operation of specialised EU institutions
Syllabus
  • 1. Establishment, development and institutional background of the EU – European Communities, scope of the EC law, its institutions , creation of the EU (1992), transformation after the Lisbon treaty (2007) 2. EU law – primary and secondary law sources, implementation, judicial protection 3. Economical background of the European integration within the EU – economic and monetary union (single European market and its four freedoms) 4. Protecton of fundamental rights and fereedoms in the EU (system of the protection, EU citizenship, Charter of Fundamental Rights and Freedoms, scope of its application) 5. Issues of the cooperation in Justice and Internal Affairs of the EU in the Period 1992 – 2009 (Third pillar of the EU and ins main legal instruments, its development due to the revisions of EU establishing treaties) 6. Issues of justice and police cooperation in the EU following the Lisbon Treaty – Head VI of the EU Treaty, its legal instruments, emergence of the EU case law 7. EU criminal law (substantial and procedural)_ protection of financial interests of the EU, corruption, trafficking, sexual abuse of minors, racism and xenophobia, human rights protection, data protection, traffic delicts, fighting against the international crime, Euro-frauds, hight-tech crimes, smuggling of drugs ext. 8. Justice cooperation – European Judicial network, Eurojust, instruments for nutual legal assistance and mutual recognition of court decisions in criminal issues, establishment of the European Prosecutor Office 9. Cooperatino EU – UK after the withdraval of the UK membershim in the Union, impacts for the ongoing and future forms of mutual assistance in justice and police cooperation ( on the example of the Czech Republic) 10. Schengen system („Schengen acquis“)- instruments, Implementing Agreement, Visa information system (VIS) 11. Europol – establishment, legal basis, tasks, activities and functions of Europol, retationships to EPA, Interpol, OLAF and/or Eurojust 12. European criminal policy – analysis of the main relevant documents and legal instruments issued with the aim to develop the cooperation on various European levels

Teaching methods
The course will be taught in Czech. The course uses a combination of lectures, seminars and problem-based assignments. Participation in most of these is mandatory
Assessment methods
An exam in the form of 20 closed questions (multiple choice), whereby 11 answers must be correct to pass the exam.
