Prerequisites
Students should be based on knowledge gained by studying TPr_1 and TPr_2. Alternatively, the subject Economic crime.
Course Enrolment Limitations
The course is offered to students of any study field.
Course objectives
The aim is that the student was able to foresee criminal business risks and prevent them. If necessary, these risks already at the legal level to tackle. It should be able to understand not only the basic concepts of criminal law and procedure, but also in economic terms and economic crime and business. Controls the knowledge and interpretative rules not only relevant criminal laws, but also a blanket callout standards that relate to this issue. This knowledge should be able to use not only in prevention activities and in solving specific cases at their workplace, but also in any subsequent cooperation with law enforcement authorities in criminal proceedings. He should be able to competently, analytically and systematically work at identifying and addressing risk factors within a business entity and also outside it. In this context, to be able to prepare in the above sense their own preventive programs aimed to reduce or eliminate criminal legal risks of business at his workplace.
Syllabus
  • 1. General interpretation, the definition of criminal business risks and opportunities preventive approach to them. Definition of economic crime, economic and financial crime. Business constitutional framework and criminal intervention of public authority in the business community. 2. Characteristics of economic and business crime, selected criminogenic factors and signals to illegal criminal activities in the economic and financial area. 3. Selected forms and methods of committing economic crimes. Especially in terms of financial, economic crime, corruption and bribery with their theoretical background and criminal characteristics of crimes against the currency. 4. Insurance, credit and subsidy fraud. 5th legalization of proceeds from crime. Complicity, favoritism, obstruct a crime and failure to report a crime. 6. Economic crime in the area of ​​taxation. 7. Economic crime and organized crime, related forms of economic crime. 8. Selected means evidence of fraud, corporate resources protection against economic crime. 9. Selected issues of criminal liability of legal persons, selected the specifics of the criminal proceedings against legal persons. 10th and interpretation of the blanket callout standards in relation to criminal legal risks in business. 11. The exposition of certain terms of the special part of the Penal Code, the law on criminal liability of legal persons and the Law on Juvenile Justice. 12th interpretation of certain terms of the special part of the Penal Code, the law on criminal liability of legal persons and the Law on Juvenile Justice.
