Course objectives
The purpose of the course is to present the theory and practical aspects of non-judicial and judicial dispute resolution and their impact on the participants to a procedural legal relationship (including economic analysis of a commercial dispute).
Learning outcomes
Students will be able to understand the advantages and disadvantages of the civil procedure, arbitration and alternative dispute resolution methods, incl. mediation. They will be able to formulate and interpret an arbitration and prorogation clause and understand the principles of determining jurisdiction in cross-border disputes. They will be able to draft simple procedural submissions and discuss procedural issues.
Syllabus
  • 1. Concept of dispute, judicial and alternative dispute resolution, judiciary in the Czech Republic, permanent and other arbitration courts, judges and arbitrators 2. Mediation, mediation agreement, mediator 3. Disputing parties, their representatives, procedural actions, means of procedural attack and defense, burden of proof and burden of assertion 4. Civil court proceedings - conciliation proceedings, preliminary proceedings, proceedings for the protection of possession and preliminary proceedings 5. Civil court proceedings - proceedings on the merits and decisions, their legal force and enforceability 6. Proper remedies in civil court proceedings 7. Extraordinary remedies in civil court proceedings, international judicial protection 8. Arbitration – arbitration agreement, course of proceedings, judicial review of the arbitration award 9. Commercial Disputes with an International Element – ​​Civil Jurisdiction and Jurisdiction, International Commercial Arbitration and the New York Convention 10. Other ADR methods (mini-trial, technical arbitration, Med-arb, domain disputes) 11. Enforcement and enforcement proceedings 12. Bankruptcy – basic principles of bankruptcy proceedings Part of the exercise will be a procedural legal case study of a specific commercial dispute connected with a visit to a court hearing in the given case.
