Course objectives
Annotation is the same for both forms of study. At the end of the course, students should be able to idenitfy the legal rules on the arbitration proceeding and mediation. They should understand the function of the civil procedural law as a supplementary egulatzion for the arbitration proceeding. They will be capable to clarify the relationship of the arbitration proceedings and rules on torts applied to entrepreneurs. They will understand the importance of arbitration in international business relations and trade.

  • 1. Introduction to arbitration procedure and alternative dispute resolution (ADR) 2. Statutory rules for arbitration, terms for the arbitrability 3. The arbitration clause -types, contents, conclusion and modifications 4. Arbitration courts- establishment, function and organization structure 5. Arbitrator- qualification, appointment, performance of the functions and responsibilities 6. Arbitration procedure 7. Decision in arbitration proceedings 8. Judicial review of arbitral awards, execution of awards 9. Special ruling of arbitration-consumer disputes, financial arbitration 10. International trade and arbitration proceeding 11. Other forms of ADR (mini-technical trial, arbitration, Med-arb, conciliation) 12. Mediation- legislation and procedure

Teaching methods
Lectures and seminars in full-time study; tutorials in part-time study; compulsory seminar participation is 75% in full-time study, compulsory tutorial participation is 50% in part-time study.
Assessment methods
Course ends with a written test. The successful passing of the test is conditioned by the correct answering of at least 14 questions from the 24 questions in total
