Course objectives (in Czech)
Cílem předmětu je získání základních teoretických znalostí trestního práva procesního a praktických dovedností při interpretaci a aplikaci právních norem v konkrétních procesních situacích. Studium začíná výkladem o účelu a smyslu trestního řízení, jenž se od dob přijetí současného trestního řádu změnil. Samostatná pozornost je věnována ochraně ústavních práv a svobod a konceptu spravedlivého trestního procesu. Výuka je zaměřena k pochopení podstaty trestního řízení a přesnému vymezení jeho předmětu. Studenti se zevrubně věnují základním principům a zásadám, které se odlišným způsobem uplatňují v různých stadiích trestního řízení. Následně poznávají role jednotlivých subjektů trestního řízení a náležitosti procesních úkonů, které činí, se zaměřením na formy rozhodnutí podle trestního řádu a problematiku jejich právní moci a vykonatelnosti. V trestním řízení hraje klíčovou roli poznání materiální pravdy, proto je pozornost věnována důkaznímu právu. Poté se studium zaměřuje na jednotlivá stadia trestního řízení, zejména na přípravné řízení (včetně zkráceného a rozšířeného přípravného řízení) a na stadia řízení před soudem. Kromě hlavního líčení, v němž je podle současné koncepce trestního řízení jádro dokazování, se výuka věnuje i problematice přezkoumávání rozhodnutí (opravných prostředků). V závěru semestru je pozornost věnována tzv. zvláštním způsobům řízení, včetně tzv. odklonů, které v současné praxi představují nejčastější vyřízení trestní věci. Opomenuty nejsou ani otázky mezinárodní justiční spolupráce se zamřením na spolupráci v rámci Evropské unie.

  • 1. Úvod do trestního práva procesního. Pojem, účel a předmět trestního řízení. Předběžné otázky 2. Ochrana ústavních práv a svobod a koncept spravedlivého trestního procesu 3. Princip kontradiktornosti a základní zásady trestního řízení 4. Subjekty trestního řízení, strany a soudy. Procesní úkony. Zajištění osob a věcí důležitých pro trestní řízení 5. Dokazování v trestním řízení. Předmět, rozsah a základní zásady dokazování. Jednotlivé důkazní prostředky 6. Rozhodnutí podle trestního řádu – pojem, formy, struktura a tvorba rozhodnutí. Právní moc a vykonatelnost 7. Přípravné řízení, jeho formy, orgány a průběh. Předběžná opatření 8. Přezkoumání a předběžné projednání obžaloby. Hlavní líčení 9. Opravné systémy a opravná řízení. Opravné prostředky v českém trestním právu. Řádné opravné prostředky – stížnost, odpor, odvolání 10. Mimořádné opravné prostředky – dovolání, stížnost pro porušení zákona a obnova řízení 11. Zvláštní způsoby řízení se zaměřením na problematiku odklonů 12. Mezinárodní justiční spolupráce v trestních věcech se zaměřením na spolupráci v Evropské unii
Teaching methods
Lectures and seminars in full-time study; tutorials in part-time study; compulsory seminar participation is 75% in full-time study, compulsory tutorial participation is 50% in part-time study.
Assessment methods
The course ends with a credit, according to the requirements of the teacher, who is awarded in the PS for a paper, incl. a seminar presentation of approximately 30 minutes; on the one hand by an oral exam at the end of the semester. The criterion for granting the credit is the elaboration of a paper on a given topic (minimum 70% of points) and its presentation in a seminar (minimum 30% of points).

Course objectives
The aim of the course is to enable students to master the fundamentals of the criminal procedure law. Tj. introduce students to basic concepts of criminal procedural law and in particular with the basic principles that represent the leading ideas and interpretative rules use the Criminal Procedure Code. So that, within the specified time allotment acquired the necessary basic theoretical knowledge. At the same time also some of the necessary skills to be able to use some means of criminal procedural law. All this opportunity for initial orientation when assessing specific situations or cases. The teaching will focus particular attention on mastering the basic principles of criminal procedure, the subjects of criminal proceedings and the parties, stages of criminal proceedings, the possibility of ordinary and extraordinary remedies, enforcement proceedings. In this context, the following are examples of practical application within the workshops of some selected institutes of Criminal Procedure.

  • Content of lectures: 1.1: Interpretation of basic categories and terminology. Subject of criminal procedural law, sources of criminal procedural law, scope of criminal procedure. Relationship between the criminal law of procedural and criminal substantive law, as well as other legal branches and disciplines that are used in criminal proceedings. The stages of criminal proceedings in general, as they result from the provisions of Section 12 (10) of the CC. 2: Constitutionally guaranteed rights and freedoms in criminal proceedings 3: Basic principles of criminal proceedings 4: Entities and parties to the criminal proceedings, their status, rights and obligations, the contradictory nature of proceedings 5: Stages of criminal proceedings. Detailed preparatory proceedings, including brief preparatory proceedings. Provisional measures. Legal regulation of the security of persons and things in criminal proceedings. Procedure before criminal prosecution, criminal prosecution and other proceedings. 6: Evidence and Evidence in Criminal Proceedings 7: Decisions in criminal proceedings. Methods and forms of decision making in criminal proceedings. 8: Court proceedings 9: Remedies, their distribution and basic features. Proper and extraordinary remedies 10: Position of the victim and the person involved. Probation and Mediation Service. 11: Special Steering Modes 12: Deviance in criminal proceedings. Execution procedure, its purpose and purpose. Principles of legal relations with foreigners in criminal matters.

Course objectives
The aim of the course is to enable students to master the fundamentals of the criminal procedure law. Tj. introduce students to basic concepts of criminal procedural law and in particular with the basic principles that represent the leading ideas and interpretative rules use the Criminal Procedure Code. So that, within the specified time allotment acquired the necessary basic theoretical knowledge. At the same time also some of the necessary skills to be able to use some means of criminal procedural law. All this opportunity for initial orientation when assessing specific situations or cases. The teaching will focus particular attention on mastering the basic principles of criminal procedure, the subjects of criminal proceedings and the parties, stages of criminal proceedings, the possibility of ordinary and extraordinary remedies, enforcement proceedings. In this context, the following are examples of practical application within the workshops of some selected institutes of Criminal Procedure.

The stages of criminal proceedings in general, as they result from the provisions of Section 12 (10) of the CC. 2: Constitutionally guaranteed rights and freedoms in criminal proceedings 3: Basic principles of criminal proceedings 4: Entities and parties to the criminal proceedings, their status, rights and obligations, the contradictory nature of proceedings 5: Stages of criminal proceedings. Detailed preparatory proceedings, including brief preparatory proceedings. Provisional measures. Legal regulation of the security of persons and things in criminal proceedings. Procedure before criminal prosecution, criminal prosecution and other proceedings. 6: Evidence and Evidence in Criminal Proceedings 7: Decisions in criminal proceedings. Course objectives
The aim of the course is to enable students to master the fundamentals of the criminal procedure law. Tj. introduce students to basic concepts of criminal procedural law and in particular with the basic principles that represent the leading ideas and interpretative rules use the Criminal Procedure Code. So that, within the specified time allotment acquired the necessary basic theoretical knowledge. At the same time also some of the necessary skills to be able to use some means of criminal procedural law. All this opportunity for initial orientation when assessing specific situations or cases. The teaching will focus particular attention on mastering the basic principles of criminal procedure, the subjects of criminal proceedings and the parties, stages of criminal proceedings, the possibility of ordinary and extraordinary remedies, enforcement proceedings. In this context, the following are examples of practical application within the workshops of some selected institutes of Criminal Procedure.

  • Content of lectures: 1.1: Interpretation of basic categories and terminology. Subject of criminal procedural law, sources of criminal procedural law, scope of criminal procedure. Relationship between the criminal law of procedural and criminal substantive law, as well as other legal branches and disciplines that are used in criminal proceedings. The stages of criminal proceedings in general, as they result from the provisions of Section 12 (10) of the CC. 2: Constitutionally guaranteed rights and freedoms in criminal proceedings 3: Basic principles of criminal proceedings 4: Entities and parties to the criminal proceedings, their status, rights and obligations, the contradictory nature of proceedings 5: Stages of criminal proceedings. Detailed preparatory proceedings, including brief preparatory proceedings. Provisional measures. Legal regulation of the security of persons and things in criminal proceedings. Procedure before criminal prosecution, criminal prosecution and other proceedings. 6: Evidence and Evidence in Criminal Proceedings 7: Decisions in criminal proceedings. Methods and forms of decision making in criminal proceedings. 8: Court proceedings 9: Remedies, their distribution and basic features. Proper and extraordinary remedies 10: Position of the victim and the person involved. Probation and Mediation Service. 11: Special Steering Modes 12: Deviance in criminal proceedings. Execution procedure, its purpose and purpose. Principles of legal relations with foreigners in criminal matters.

The course is offered to students of any study field.
Course objectives
The aim of the course is to enable students to master the fundamentals of the criminal procedure law. Tj. introduce students to basic concepts of criminal procedural law and in particular with the basic principles that represent the leading ideas and interpretative rules use the Criminal Procedure Code. So that, within the specified time allotment acquired the necessary basic theoretical knowledge. At the same time also some of the necessary skills to be able to use some means of criminal procedural law. All this opportunity for initial orientation when assessing specific situations or cases. The teaching will focus particular attention on mastering the basic principles of criminal procedure, the subjects of criminal proceedings and the parties, stages of criminal proceedings, the possibility of ordinary and extraordinary remedies, enforcement proceedings. In this context, the following are examples of practical application within the workshops of some selected institutes of Criminal Procedure.

  • Content of lectures: 1. General interpretation, the concept of criminal proceedings, the sources of criminal procedural law, the jurisdiction of the Criminal Procedure Code. 2. Constitutionally guaranteed rights and freedoms in criminal proceedings. 3. Basic principles of criminal procedure. 4. Subjects and sides of criminal proceedings, their status, rights and obligations. 5. Stages of criminal proceedings, pre-trial proceedings, securing persons and things in criminal proceedings. 6. Evidence and evidence in criminal proceedings. 7. Decisions in criminal proceedings. 8. Proceedings before the Court. 9. Ordinary and extraordinary remedies. 10. Position of the victim and the person concerned. 11. Special methods of management. 12. Proceedings and diversion in criminal proceedings, legal relations with foreign countries.

Teaching methods
Lectures and seminars in full-time study; tutorials in part-time study; compulsory seminar participation is 75% in full-time study, compulsory tutorial participation is 50% in part-time study.
Assessment methods
The course is completed with a credit and verbal exam. A specific written study (50% points min) and 30 written test questions (50% points min) is required to award the credit. Answer one of the 15 topic questions correctly is required to pass the exam.
