Course Enrolment Limitations
The course is offered to students of any study field.
Course objectives
The aim of the course is to enable students to master the fundamentals of the criminal procedure law. Tj. introduce students to basic concepts of criminal procedural law and in particular with the basic principles that represent the leading ideas and interpretative rules use the Criminal Procedure Code. So that, within the specified time allotment acquired the necessary basic theoretical knowledge. At the same time also some of the necessary skills to be able to use some means of criminal procedural law. All this opportunity for initial orientation when assessing specific situations or cases. The teaching will focus particular attention on mastering the basic principles of criminal procedure, the subjects of criminal proceedings and the parties, stages of criminal proceedings, the possibility of ordinary and extraordinary remedies, enforcement proceedings. In this context, the following are examples of practical application within the workshops of some selected institutes of Criminal Procedure.

Syllabus
  • Content of lectures: 1.1: Interpretation of basic categories and terminology. Subject of criminal procedural law, sources of criminal procedural law, scope of criminal procedure. Relationship between the criminal law of procedural and criminal substantive law, as well as other legal branches and disciplines that are used in criminal proceedings. The stages of criminal proceedings in general, as they result from the provisions of Section 12 (10) of the CC. 2: Constitutionally guaranteed rights and freedoms in criminal proceedings 3: Basic principles of criminal proceedings 4: Entities and parties to the criminal proceedings, their status, rights and obligations, the contradictory nature of proceedings 5: Stages of criminal proceedings. Detailed preparatory proceedings, including brief preparatory proceedings. Provisional measures. Legal regulation of the security of persons and things in criminal proceedings. Procedure before criminal prosecution, criminal prosecution and other proceedings. 6: Evidence and Evidence in Criminal Proceedings 7: Decisions in criminal proceedings. Methods and forms of decision making in criminal proceedings. 8: Court proceedings 9: Remedies, their distribution and basic features. Proper and extraordinary remedies 10: Position of the victim and the person involved. Probation and Mediation Service. 11: Special Steering Modes 12: Deviance in criminal proceedings. Execution procedure, its purpose and purpose. Principles of legal relations with foreigners in criminal matters.

Teaching methods
Lectures and seminars in full-time study; tutorials in part-time study; compulsory seminar participation is 75% in full-time study, compulsory tutorial participation is 50% in part-time study.
Assessment methods
The course ends with a credit, according to the requirements of the teacher, who is awarded in the PS for a paper, incl. a seminar presentation of approximately 30 minutes; on the one hand by an oral exam at the end of the semester. The criterion for granting the credit is the elaboration of a paper on a given topic (minimum 70% of points) and its presentation in a seminar (minimum 30% of points).
