Abstract
DPH je jednou z nejvýznamnějších daní daňové soustavy. Konstrukce této daně však vede v posledních letech k růstu mezery mezi teoretickým a skutečným výnosem DPH. K tomu přispívají zejména rozmáhající se kolotočové podvody. Reakcí na ně jsou četné změny právních předpisů na evropské i národní úrovni, což dále snižuje neutralitu daně a posiluje distorze. Cílem příspěvku je navrhnout takové úpravy, které by tento stav pomohly řešit. Existují dvě zásadní možnosti, buď zavedení principu zdanění v zemi původu včetně zdanění vývozu a intrakomunitárních dodávek, nebo přechod na zcela jiný princip této daně prostřednictvím totálního zavedení přenesené daňové povinnosti.
Abstract (in English)
VAT is one of the most important duties of the tax system. The construction of it has, however, increased the gap between theoretical and actual return of VAT. Particularly rampant carousels frauds to this. Numerous legislative changes further reduce the tax neutrality and strengthen distortions. The aim of this paper is to propose adjustments that might help resolve such a situation. There are two major possibilities to achieve the goal: by introducing taxation in the country of origin, including taxation of exports and intra-Community business, or switching to an entirely different principle of taxes through reverse charge.
