Course objectives
Annotation is the same for both forms of study. At the end of the course the student will be able to understand the system of private law and the basic principles and the principles of private regulation. They understand and understand the norms of civil law as a basic private sector. Can clarify its relationship to the other sectors of private law, its sources, the internal system, basic principles and institutions. In the area of ​​civil law with the ability to explain the legislation persons, legal facts (in particular legal negotiations - contracts, family law, absolute and relative property rights. Understand the basics of civil procedure including insolvency and arbitration.
Syllabus
  • This curriculum is designed for full-time and part-time study. Content of lectures: 1st) The distinction between private and public law. Civil Law and Procedure. Principles of private law. Historical development of civil law in the Czech Republic. Interpretation of the rules of civil law. 2nd) The legal personality. Natural and legal persons. Services with no personality - Trust Fund, the company (§ 2716 et seq.) And animals. Incapacitation. Personality. Types of legal entities - corporations, foundation, constitution. Consumer. Entrepreneur. The weaker party. Representation - contractual, legal and guardianship. 3rd) The concept of business corporations - commercial companies and cooperatives, and private capital company, the establishment of a corporation, Termination and dissolution of corporations, groups of companies. 4th) Legal negotiation, interpretation and form of legal proceedings. Defects legal action - nothingness, nullity of legal proceedings, the relative ineffectiveness of legal proceedings. Legal events. Limitation and prescription periods. 5th) Establishment and termination of the marriage. Marital property law. Determination of parenthood. Mastering. Maintenance obligations. Parental responsibility. Guardianship and other forms of child care. 6th) Things and their distribution. Real rights as absolute property rights. Tenure. Ownership. Co-ownership. Rights to foreign affairs. Cadastre. 7th) The concept of inheritance law. Estate. Heritage. The exclusion of the heirs of inheritance law. Inheritance titles. Link. Liability for debts of the deceased 's heirs. 8th) The reasons of liability. Contract. Content commitments. Liabilities arising from contracts concluded with consumers. Common debts and receivables. Changes in liabilities. Of the liability. Securing and establish the debt. 9th) The contract types according to NOZ . 10th) Compensation for material and non-material damage. Unfair competition. 11th) Unjust enrichment. Unattached agency and use another's property for the benefit of another. 12th) The types and kinds of civil justice process. The principles of justice and civil process. The bodies of civil procedure. Institutes of civil procedure. Corrective procedure. Enforcement of decisions and execution. Insolvency proceedings. Alternative dispute resolution.

Teaching methods
Lectures and seminars in full-time study; tutorials in part-time study; compulsory seminar participation is 75% in full-time study, compulsory tutorial participation is 50% in part-time study. Students who do not fulfil the compulsory attendance may be assigned additional study tasks throughout the term (in an extent that will prove study results and acquired competencies necessary for successful completion of the course)
Assessment methods
Exam written test (or oral examination). Successful completion of the course is conditional on answering correctly at least 60% of the questions written test.
