Course objectives
Po absolvování kurzu bude student schopen porozumět a vysvětlit vývoj a současnou podobu institucionální struktury Evropské unie, jakož i problematiku fungování klíčových kapitol evropského práva. Studenti budou schopni popsat dosavadní vývoj evropské integrace a vznik institucí EU, dále identifikovat právní základy současného nadnárodního mechanismu a nastínit možné perspektivy dalšího vývoje. Bude schopen interpretovat relevantní judikaturu Soudního dvora EU a Ústavního soudu České republiky. Studenti budou schopen kriticky reflektovat hlavní momenty současné politické a právní diskuse o aktuální podobě a reformách EU ve vztahu k členským státům a dalším subjektům na globální úrovni.

  • 2. Basic terminology of the EC/EU before and after the Lisbon Treaty
  • 3. Division and exercise of the powers by EU institutions and the Member States (categories of competence)
  • 4. Principles of subsidiarity and proportionality,
  • 5. Establishment and termination of membership, suspension of membership rights
  • 6. Sources of EU law (hierarchy and system)
  • 7. The relationship of EU law to the law of MS, the harmonisation of national laws
  • 8. Secondary legislative acts of the EU and EU case law
  • 9. The direct effect of EU law
  • 10. The importance of the Lisbon Treaty
  • 11. Composition, powers and functioning of the main institutions of the EU (EP, EU Council, Commission, European Council, EU COurts

Teaching methods
Lectures in full-time study; tutorials in part-time study; compulsory seminar participation is 75% in full-time study, compulsory tutorial participation is 50% in part-time study.
Assessment methods
The course is completed by passing of a written test, containing closed and/or open questions. Criterion for successful closing is a minimum of 55% points awarded for correct answers .
