The course is offered to students of any study field.
Course objectives
The aim of the course is to extend the teoretical basis for further study of effective legal norms and to give the overview of important turning points of the evolution of private law in the European legal culture. Students should understand historical conditions of contemporary shape of private law in Czech Republic. They will be conversant with alternative ways of arrangement of concrete legal institutes and obligations in different historical eras in different countries as well.
Syllabus
1. Beginning of the private law relationships in ancient Oriental states. 2. Private law realtionships in ancient Greece. 3. Roman law - overview of the development of Roman law and state . 4. Roman law – rights in personam and rights in rem. 5. Roman obligational law. 6. The concept of proprietary right and possession. 7. Rodinné a dědické právo ve středověku a raném novověku. 8. Historickoprávní analýza vývoje konceptu právnických osob. 9. Code Civil a jeho srovnání s ABGB. 10. Kodifikace občanského práva v Německu – Landrecht (1794) a BGB (1896). 11. Švýcarský občanský zákoník. 12. Evropské kodifikace obchodního práva (k otázce vztahu práva občanského a obchodního).

Teaching methods
Lectures and seminars in full-time study; tutorials in part-time study; compulsory seminar participation is 75% in full-time study, compulsory tutorial participation is 50% in part-time study.
Assessment methods
The course is completed with a credit and an exam. A credit is given for a written paper (at least 6 pages). An oral exam is passed successfully, if a student answers correctly one drawn question.
