Course objectives
At the end of this course, the student will be able to understand and explain the criminal law aspects of public administration. The student will get a comprehensive overview of legal relations in the area of ​​criminal law in public administration. Studen will be able to distinguish between liability under private law, labor law, properly legal and criminal law. It can specify public administration subjects and executors, public officials and the relationship between public officials and public administration subjects as employers of public officials. Criminal legal relations are then presented mainly in the section governing the criminal liability of officials in the exercise of public authority, and the liability of other persons against order in public affairs, where students are presented with the system and individual types of punishments according to criminal regulations. The student will get a comprehensive overview of individual criminal acts related to the performance of public administration. At the same time, the student will understand the principles of criminal procedure.
Learning outcomes
Basic theoretical knowledge, orientation in the problems and contexts of the monitored topics. At the same time, practical abilities and skills in the application of acquired knowledge in the real environment of professional activities. The learning outcome is the support and development of the profile of an educated practitioner.
Syllabus
  • 1. Introduction to study and basic concepts; criminal law (concept, subject, characteristics). Criminal law substantive, procedural, sources of criminal law. 2. Concept of public administration (concept, subject, characteristics). Constitutional limits and basic principles of public administration. Legislation. 3. Concept and general principles of responsibility, responsibility for damage caused during public performance (distinction and principles of responsibility under private law, labor law, proper legal and criminal law). Legislation. 4. Subjects and executors of public administration, officials. The relationship between officials and public administration entities. Employment relationship of officials of territorial self-governing units, service relationship. Legislation. 5. Criminal responsibility, legal regulation, principles. Criminal offence, the facts of the criminal offence, culpability, intention, negligence, circumstances precluding illegality, concurrence of criminal offences. 6. Criminal liability of officials in the exercise of public authority (liability of officials). 7. Liability of other persons against order in public affairs. 8. Types of criminal sanctions (punishments and protective measures). Principles for the imposition of penalties and protective measures. 9. Crimes related to the performance of public administration: crimes against freedom and human dignity; crimes against public order; criminal acts of official persons; bribery; other disturbances of public order. 10. Principles of criminal procedure, legislation and principles of criminal procedure. Subjects of criminal proceedings and their position in criminal proceedings. 11. Stages of criminal proceedings and the course of criminal proceedings: preliminary proceedings. 12. Stages of criminal proceedings and the course of criminal proceedings: proceedings before the court (main trial, ordinary and extraordinary remedies, diversions in criminal proceedings).
