- Cíle předmětu
- Upon successful completion of the course, students will be able to: • Understand the basic principles and functions of industrial property rights. Explain the significance of individual forms of industrial property rights (patents, trademarks, industrial designs, etc.) in a business and innovation context. • Describe the national, European and international legal framework for the protection of industrial property. • Apply legal and economic knowledge to specific situations. Identify the appropriate type of legal protection for a specific type of innovation or trademark. Search for and interpret relevant information from public databases (e.g. ÚPV, Espacenet, TMView). Explain the process of industrial rights registration in practice. • Design and evaluate licensing strategies. Distinguish between types of licences and propose an appropriate license agreement structure for a specific business model. Explain the impact of licensing on corporate finance, innovation, and market position. • Consider the advantages and risks of various forms of intellectual property commercialization (e.g. franchising, transfer, spin-off). • Critically evaluate violation of rights and propose legal solutions. Recognize violation of industrial rights and propose possible legal actions, including enforcement of claims. Explain the possibilities for protecting industrial rights in digital environment (e.g. online trademarks, software patents). • Be familiar with current trends and case studies from practice. Analyze specific cases (e.g. litigation, licensing negotiations, strategic use of IP in business). Discuss the development and impact of industrial rights in the context of globalization, digitalization and ESG.

- Lectures 1. Introduction to intellectual property and industrial rights. Distinction between copyright and industrial rights. The role of industrial rights in the economy and innovation. Overview of the main types of industrial rights (patents, utility models, industrial designs, trademarks) 2. Legal framework for industrial rights in the Czech Republic and the EU. Sources of law: national, EU, and international regulations. Industrial Property Office (ÚPV), European Patent Office (EPO), EUIPO. Role of WIPO (World Intellectual Property Organization) 3. Trademarks in business. What is a trademark, its function and types. Registration process, national and international registration. Practical examples of misuse and disputes (e.g. trademarks in e-commerce) 4. Patents and utility models: protection of technical solutions. The difference between a patent and a utility model. Conditions for patentability, application process. Economic impacts of patent protection and corporate patent strategies 5. Industrial designs and their significance. Aesthetic protection of products and designs. Strategic use in a competitive environment. Well-known cases from practice (e.g. car design, electronics) 6. Licensing of industrial rights – theoretical foundations. What is a license, types of licenses (exclusive, non-exclusive, open). Legal framework for licensing in the Czech Republic and the EU. Obligations and rights of the contracting parties 7. Contractual aspects of licenses. Structure of a license agreement. Key points: scope, territorial validity, duration, reward. Dispute resolution, termination, transfer of rights 8. Valutation and commercialization of industrial rights. Methods of valuing intangible assets (market, cost, income approaches). Transfer of rights, franchising, spin-offs. The role of industrial rights in due diligence and mergers 9. Protection of rights and enforcement of claims. Violation of rights, counterfeiting, unfair competition. Defense options: judicial and extrajudicial remedies. The role of customs authorities and law enforcement agencies 10. Industrial property rights and the digital economy. Challenges of digitalization: software, AI, databases. Patents for computer inventions, protection of algorithms. Trademarks and the internet (e.g. domain disputes, online platforms) 11. International dimension of industrial rights. International contracts (Paris Convention, TRIPS, Madrid Agreement, etc.) Global protection of trademarks and patents. Practical problems: parallel imports, enforcement in China, USA 12. Current trends and case studies. Analysis of current disputes and decisions (e.g. Apple v. Samsung). ESG and IP: sustainability, ethics, green technologies. - Lectures The lectures are designed as interactive explanatory blocks that link the legal framework with the economic and managerial aspects of industrial rights. The key objective is to promote deeper understanding through real-life examples and the application of acquired knowledge in a business context. The teaching methods used include: Expert commentary with an emphasis on interdisciplinarity. Explanation of legal institutions in relation to business practice (e.g. how patents affect competitive advantage, licensing revenues, etc.). Emphasis on the differences between the legal and economic perspectives on intellectual property. Working with real case studies. Analysis of court decisions (e.g. EUIPO, EPO, Czech courts) or well-known disputies (Apple v. Samsung, Coca-Cola v. Pepsi etc.). Group discussions on legal dilemmas and strategic choices of companies. Demonstrations using databases and visualizations. Practical work with trademarks and patent databases (e.g. Espacenet, TMView, eSearch, etc.). Visualization of data on rights applications, trends and the economic impact of IP using statistics (e.g. from WIPO, EUIPO etc.). Activating elements within lectures. Short case studies or surveys during lessons (e.g. „How would you protect this product?“). Brainstorming and decision-making on hypothetical licensing strategies. Modern methods (supported by technology) – motivation, greater interactivity In order to increase student engagement, the applicability of knowledge, and support for active learning, the following modern and digitally supported methods are incorporated into teaching: 1. Interactive voting and quizzes in real time. Tools: Slido, MS Teams etc. Used for quick comprehension checks (e.g. „What can be patented?“), opinion polls, and decision-making dilemma simulations. Encourages active participation even among less proactive students. 2. Simulations and scenarios supported by online platforms. Example: Simulation of license negotiations in groups – one group represents the company owning the patent, the other the potential acquirer. Enables the development of argumentation, negotiation skills and teamwork. 3. Working with open databases and visualizations. Practical exercises in working with trademarks and patent databases. Assignment: „Search for whether there is a trademark XY for a given type of product,“ „Find an example of an industrial design in the cosmetics industry.“ Development of skills relevant to practice (due diligence, market analysis). 4. Video analysis and micro-case studies. Short videos with examples of well-known disputes or licenses (e.g. Apple v. Samsung design dispute, Starbucks branding v. local businesses). Accompanying questions: „Which rights were violated?“, „How would you proceed as a company manager?“ Increases engagement and promotes critical thinking. 5. AI tools and assistants for independent study. Recommendations for using tools such as ChatGPT, Consensus or Elicit to research the legal and economic aspects of IP. Supports independent thinking and source verification (with an emphasis on critical reading of outputs). Suitable for creating materials for group presentations or case studies. 6. Gamified elements. Points for participating in discussions, solving cases, being the most active trademark searcher, „industrial rights detective“, etc. Possibility of symbolic rewards or priority selection of seminar paper topics. Increases internal motivation and competitiveness.
