- Prerequisites
- Prerequisite is completion of the Foundamentals of law, knowledge of private law terminology, especially institutes of constitution, civil law and basic legal theory, and an overview of basic human rights under CFRBF.
- Course Enrolment Limitations
- The course is offered to students of any study field.
- Course objectives
- At the end of the course students should know the institutes of copyright law as a component of intellectual property rights; be able to explain the theory, content and subject, the effects of legal acts in this field, especially the license agreement, and the consequences of a breach copyright act. Students should know the rules of media such as print, broadcast and television and the internet, and their effects on society and the legal relations in connection with the copyright act. At the end of the course the student should be able to explain and interpret media and copyright institutes to apply theoretical information, create copyright documents, the student is able to contractual relationships to protect their rights and obligations.
- Learning outcomes
- After completing this course, the students will be able to: - detect potential legal problem - find out which act to look in for solving the problem - provide basic knowledge of this area of law
- Syllabus
- 1. The concept of copyright as an independent field of private law 2. The concept of copyright works and the kinds of works. The concept of the author. Statutory presumption of authorship 3. Contents copyright. Copyright personality and property. Prerequisites copyright relations. Types copyright agreements 4. Free access to the works and gratuitous legal license 5. Rights of Performers, concept artist, artistic performance 6. Copyright Infringement consequences administrative punishment for violations under the Copyright Act 7. Special arrangements uncreative rights under the Copyright Act (law publishers, television and radio broadcasting) 8. Collective management of rights, collective management organizations 9. Czech Television, Czech Television Act, Czech Radio Act on Czech Radio. The law on television and radio broadcasting. 10. The concept of the information society, internet, video-on-demand 11. Periodical and non-periodical publications, press laws 12. International agreements in the field of copyright and media rights In detail: 1. Copyright – summary of key aspects of copyright – what works attract copyright protection, what does copyright protection confer, what is the term of the protection, ownership of a copyright work, moral and economic rights, rights related to copyright 2. Dealing in or using the copyright work – infringement – exceptions and defence to copyright infringement, remedies for infringement 3. Dealing in or using a copyright work – assignment and licensing – transferring rights and licensing rights, collecting societies 4. Moral rights and passing off and personality rights – advertisement and merchandising 5. Databases and Trademarks – use, protection, exploitation and enforcement 6. Copyright and the Internet – the position of ISP, file sharing, online liability 7. Broadcasting – television and radio regulatory policy, bodies, application of regulation, advertising regulation 8. Print media – ownership, regulation of periodical and non-periodical publications, liability of publishers and freedom of speech 9. Civil Code – protection of personal rights and reputation, defamation, libel, slander, unjust enrichment – protection of name, image, reputation, goodwill of legal entities 10. Civil Code – protection of personal rights in digital world, ISP liability, claims, defence and remedy 11. The press act – right to reply, right to subsequent statement, the broadcasting act terms 12. Data Protection and freedom of information act – what is the definition of data, personal data, duties to controller, the right to access to information, EU context, GDPR

- Teaching methods
- Lectures and seminars in full-time study; tutorials in part-time study; compulsory seminar participation is 75% in full-time study, compulsory tutorial participation is 50% in part-time study.
- Assessment methods
- The course is completed with written exam. The written exam consists of 20 multiple choice test questions, 20 points max, 13 points min is required to pass the exam.
