Abstract |

Smyslem tohoto článku bylo pojmenovat některé ze zásadních autorskoprávních otázek vznikajících při nakládání s národním archivním dědictvím a tam, kde to je možné, nabídnout odpovědi či alespoň podle autorova přesvědčení nejlepší možná řešení. Mám za to, že je současně zjevné, že autorské právo není žádnou překážkou v činnosti archivů či jiných paměťových institucí a že autorský zákon pečlivě váží jak veřejný zájem na ochraně tvůrčí činnosti, tak zájem na přístupu ke kulturnímu bohatství, jak oba tyto póly umělecké tvorby reflektuje Listina základních práv a svobod. Napětí mezi paměťovými institucemi (zejména pak knihovnami) a nositeli práv je proto zbytečné, akceptují-li obě strany limity svých práv – legitimní touha paměťových institucí po zpřístupnění obsahu musí respektovat oprávněné zájmy autorů a dalších nositelů práv. Ostatně, pokud by nebylo autory tvořeného obsahu, nebylo by knihoven. V závěru svého příspěvku proto nabízím možná řešení nejpalčivějších konfliktních situací (osiřelá díla, digitalizace apod.) v podobě rozšířené kolektivní správy práv autorských a souvisejících s právem autorským. U problému půjčování autorským právem chráněných archiválií na místě samém se přikláním k tomu, že bychom je neměli považovat za užití díla v autorskoprávním smyslu v návaznosti na unijní úpravu. |

The author outlines the basic copyright norms whose implementation archival work has to wrestle with on a daily basis. Despite the challenges digitisation poses for copyright, the writer points out that it is not a system error but rather an intentional attribute of copyright that it restricts the reproduction of content, unlike the reproduction of information or the dissemination of ideas. Some conflicts between the interests of archives and other memory institutions on one side and copyright on the other side can be resolved by reasonable interpretation, in which copyright is not an obstacle but a support to archival work. The author explains some general problems related to the protected subject matter, official works (including works of foreign governments), the National Film Archive’s sui generis “right of management” with the audiovisual works, the issue of technical norms, the management of databases, the character of archival aids as databases, the library exception to copyright and its application to undisclosed works and works protected by technical protection measures. Besides that, the author specifically addresses some shortcomings in legislation: improper harmonisation of the right of the first publisher of a work (EU law speaks about published work and first publisher while the Czech law speaks about divulged works), improper harmonisation of the lending right (EU law does not regard borrowing a book within the library as copyright relevant use), insufficient regulation of orphan works (possible solution by extended collective rights management), etc. Where it is not possible to overcome shortcomings in regulations by interpretation, the writer offers solutions (the issue of the transferability of the rights of the first publisher of public domain works, regulation by archival policies, remote access of researcher to the archival content, etc.). |
