Abstract
Přednáška k problematice autorského práva, práv souvisejcích a výtvorům umělé inteligence. Přednáška se zabývá tradičními problémy autorského práva (záměrnost/nezáměrnost, uvědomělost, aleatorika, výtvory zvířat, díla vytvořená s pomocí počítače) v novém kontextu výtvorů umělé inteligence, připomíná se rozhodnutí Acohs Pty Ltd v Ucorp Pty, a otevírá se možnost ochrany výtvorů AI (vedle autorského práva pak práva související s právem autorským). Pozornost je též věnována odpovědnosti provozovatele AI za zásah do autorského práva v procesu "učení se" AI (budování databázy).
Abstract (in English)
Contribution dealw with problems of author's and related rights and AI's creations. It is dealt with traditional copyright problems (intentionality, consciousness, aleatoricism, creations of animals, works created with the assistance of a computer) in the new context of AI's creations. The decision Acohs Pty Ltd v Ucorp Pty is discussed, as well as possibilities for protection of AI's creations (besides author's rights by means of related rights). An important question of infringement of third party copyright in course of the AI's "learning" process is opened as well.
