- Course objectives
- At the end of this course the student will be able to understand and explain the criminal law aspects of public administration. The student will get a comprehensive overview of the responsibilities associated with the performance of public administration. Studen will be able to distinguish between private, labor, legal and criminal law responsibilities. It is able to specify the bodies and the executors of the public administration, the officials and the relationship of officials and public administration bodies as employers of official persons. Criminal-law aspects are introduced above all in the section dealing with the criminal liability of officials in the exercise of public authority, and the responsibility of others against the order in public affairs, where students are introduced a system and individual types of punishments under criminal law. At the same time, the student will understand the principles of criminal proceedings and will be able to distinguish sanctions of administrative and criminal penalties, and the different differences in terms of imposing and executing these sanctions.
- Learning outcomes
- Basic theoretical knowledge, orientation in problems and context of monitored topics. At the same time, the practical skills and skills of applying the acquired knowledge in a real environment of professional activities. The learning outcomes are the support and development of the profile of the educated practitioner.
- Syllabus
- 1581/5000 1. Introduction to the study and basic concepts; public administration (concept, subject, characteristics). Constitutional limits and basic principles of public administration. 2. Concept and general principles of liability (distinction and principles of private, labor law, administrative law and criminal law). Legislation. 3. Entities and executors of the public administration, officials. Relation between officials and public administration bodies. Employment of local government officials, service ratio. Legal regulation.4. General liability for damage caused by the exercise of public authority by decision or by maladministration. 5. Criminal liability, legal regulations, principles. Criminal offense, offense, guilt, intent, negligence, unlawful circumstances, concurrence of criminal offenses. 6. Criminal liability of officials in the exercise of public authority (liability of officials). 7. Liability of others against order in public affairs. 8. System and types of sentences. 9. Criminal offenses related to the performance of public administration: crimes against freedom and human dignity; criminal offenses against public order; offenses of officials; bribery; other public order interference. 10. Principles of criminal proceedings, legal regulations and principles of criminal proceedings. Entities of criminal proceedings and their position in criminal proceedings. 11. Stages of criminal proceedings and the course of criminal proceedings: preparatory proceedings, main appeals, ordinary and extraordinary remedies, deviations in criminal proceedings. 12. Comparison of administrative and criminal law sanctions. Specifics and differences in the conditions of their storage and performance.

- Course is successfully completed credit. Criterion for the granting of credit is at the written test, which consists of thirty questions (minimum 50% points).
