Course objectives
Acquisition of legal bases of business activity in connection with the danger of committing crimes in this area. Entrepreneurial activity as a part of activity in society, where the criminal activity of offenders is either based on their position within the business or criminal activity focused on the business sphere from the outside. Getting acquainted with this issue for selected crimes listed in a special part of the Criminal Code, detailed acquaintance with aspects of criminal liability of natural and legal persons, the development of crime in the field of business activities, the development of court decision-making practice in this area.

Successful passing of the exam from the subject.
Syllabus
  • 1) Definition of business activities from the point of view of criminal law. According to the doctrine and from the point of view of the relevant case law of the General Courts, the ECtHR and also the Constitutional Court. 2) Legal regulation representing the definition of the objective side of selected criminal offenses in this area. 3) Impacts of violation of blanket reference legal norms in business activities. Illegal activity forming the so-called foreground of criminal activity within business. Possibilities of preventive action. 4) Aspects of criminal liability of legal persons 5) Aspects of criminal liability of natural persons. 6) Crimes against property. 7) Economic crimes 8) Other crimes in connection with business activities 9) Criminal proceedings in matters of crimes in the business area. The issue of damages. Status of stakeholders. 10) Legalization of proceeds of crime.
