N2 - Legal relations arising before the date of entry into force of this new Civil Code, as well as the rights and obligations arising from it shall be governed by the existing rules to continue. For these reasons dealt with at least briefly about the commercial treatment of the conclusion of conctracts, knowledge of the practices and arrangements in the new Civil Code. Conclusion of contracts in the Commercial Code, provided for by the provisions of section 269 to 275 under the heading Some provisions on the conclusion of the Treaty, of which it is clear that in the Commercial Code, we can find only part of the edits. The basis of legislation is in the provisions of § 43 to 51 of the Civil Code. De lege ferenda, it is appropriate to build on the already created in Europe a common reference framework (DFCR). Effected from 1.1.2014 legal relations are subject to the new Civil Code.
